The terms and conditions for our Landing Pages, Digital Business Cards, Digital Presentations and Digital Signs products.

PresentingX (“PresentingX,” “we,” “our,” or “us”) is a digital presentation and landing-page platform operated by EX Labs. By accessing or using https://presenting.xyz, you agree to these Terms of Use (“Terms”). If you do not agree, do not use the service.

1. Services Provided

PresentingX provides digital services including, but not limited to:

  • Digital business cards
  • Landing pages
  • Micro-sites
  • Digital presentations
  • Branded hosted profiles

Services may include one-time setup, customization, hosting, and subscription-based access.

2. Authorization to Charge

By submitting payment, you explicitly authorize PresentingX and EX Labs to charge your selected payment method for:

  • One-time setup fees
  • Subscription or recurring hosting fees
  • Any approved additional services

You acknowledge that setup services begin immediately upon payment unless otherwise stated.

3. Non-Refundable Fees & No-Chargeback Policy

3.1 Setup Fees (STRICTLY NON-REFUNDABLE)

All setup fees are non-refundable and non-chargebackable.

This includes, without limitation:

  • Landing page setup
  • Micro-site creation
  • Digital presentation design
  • Initial configuration, customization, or onboarding

Once payment is submitted and work has begun, no refunds, reversals, or credits will be issued, regardless of:

  • Usage or lack thereof
  • Perceived dissatisfaction
  • Early termination
  • Failure to request or complete revisions

3.2 Subscription Fees

Subscription and hosting fees:

  • Are billed in advance
  • May be canceled for future billing periods
  • Are not refundable once charged

Cancellation does not entitle you to a refund for any previously billed period.

4. Chargebacks & Payment Disputes

4.1 Improper Chargebacks

You agree not to initiate a chargeback or payment dispute for any charges that comply with these Terms.

Initiating a chargeback for a legitimate, authorized, and delivered service constitutes a breach of these Terms.

4.2 Chargeback Evidence Authorization

You expressly authorize PresentingX and EX Labs to submit the following as evidence in response to any dispute or chargeback:

  • These Terms of Use
  • Proof of payment and invoices
  • Service descriptions and onboarding records
  • System access logs
  • Delivery confirmations or published content
  • Communications (email, platform messages, or forms)

4.3 Administrative Fees for Chargebacks

If you initiate a chargeback in violation of these Terms, we reserve the right to:

  • Suspend or terminate your account immediately
  • Recover any chargeback fees imposed by Stripe or card networks
  • Invoice you for an administrative dispute handling fee (where permitted by law)

5. Account Suspension During Disputes

Any active dispute or chargeback may result in:

  • Immediate suspension of access
  • Removal or unpublishing of hosted content
  • Withholding of further services until resolution

Service restoration is not guaranteed, even if the dispute is resolved.

6. Acknowledgment of Digital Service Delivery

You acknowledge and agree that:

  • PresentingX provides digital services, not physical goods
  • Delivery may include access credentials, live URLs, drafts, or published content
  • Digital services are considered delivered once access or work commences

This acknowledgment is intended to satisfy card network requirements for non-tangible goods and services.

7. Client Responsibilities

You are responsible for:

  • Providing accurate content and approvals
  • Reviewing deliverables in a timely manner
  • Maintaining backups of your content

Delays or non-responsiveness do not affect billing or refund eligibility.

8. Intellectual Property

All platform software, templates, branding, and systems remain the intellectual property of EX Labs. No ownership is transferred unless explicitly stated in writing.

9. Disclaimer of Warranties

Services are provided “as is” and “as available.” We disclaim all implied warranties, including fitness for a particular purpose or uninterrupted availability.

10. Limitation of Liability

To the fullest extent permitted by law, liability shall not exceed the total amount paid to PresentingX in the three (3) months preceding the claim.

11. Termination

We may terminate or suspend access at our discretion for:

  • Non-payment
  • Abuse of the platform
  • Violation of these Terms
  • Improper chargebacks or disputes

Termination does not entitle you to refunds.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which EX Labs operates, without regard to conflict-of-law rules.
